Debt in UK. Living in EU

I moved away from the UK and continued to pay debts. I became unemployed about 2 and half years ago and through a lot of negotiation with the banks in the UK they refused to help. I had no choice but to stop paying.

I am just a person who was unable to pay back the last 2 years of a 5 year loan in the UK. After trying to negotiate by the advise from national debt line in the uk the banks refused to help. I could not go bankrupt in the UK because I did not live there. I am unable to receive a uk court order, you need to be resident in the country.

There were two banks. 4k loan and a 7k loan. Which I had paid the interest at the point of stopping. They have me down at my mothers address in the UK even though I dont live there anymore. Through continous chasing for about 3 months all went very quiet, this was 2 years ago at least, they had stopped chasing. All was quite for 2 years until now.

Now, one of them have contacted my mothers house again out of the blue saying that they have passed the debt on. There was also a letter from a debt collection agency stating they are now the guys looking for it. They had breifly spoke to my Mother on the phone asking where I was, which she replied, ''living abroad, I dont know where''...The conversation ended there.

I am in a European country. Which does not have any agreements with the UK in terms of debt.

Now, my question is. Do they have any real chance of even beginning to recover the debt, even if they do not know where I am. Would it be better if they did know that I was, in fact, no longer in the country? What would be the situation if they did find out where I was? UK laws don't work here, where I am. Are they just going to keep chasing and chasing at an address, and at a phone number where I dont live?

Any 'constructive' advise from people who actually know would be great. Can I politely ask people who dont know, to not post the first thing that pops into their head as it's very un helpful.

Thanks

As this is in Irish site (refer to site FAQ's, About the site, etc.) it is unlikely you will get access to posters knowledgeable in both UK and EU debtor law.

I do know that your mother is going to start getting a lot of hassle, I am not going to lecture you on paying debt but the fact is they will continue to contact and go to the address chasing a debt and your mother will see more of them

would you be in a position to make any payments, bear in mind everytime the debt collectors call they will charge more in fees

good luck with your choice

I owed a small amount on a couple of bills (ex was supposed to pay them off but never did and unfortunately were in my name) in the UK dating back to over 7 years ago. I was living in rented property in a building where nobody knew me. Admittedly the amounts were only about 200 and 400 pounds sterling but it never came back to haunt me.

Also I had a boss a couple of years ago that had post going to his old house in Wales. He rented it out for years an it turned out that 4 years previously a tenant had picked up a card in his name and run up 4000k on it before leaving. He wasn't collecting his post so he never knew anything about it until he applied to remortgage the house from over here. He knew nothing about it until the mortgage got turned down and it was only when he checked his credit rating through one of the agencies that he even found out.

They can only chase you for a certain number of years for old debts, the full details are here [broken link removed]

This is a excellent site for people in the UK regarding debt, it is an eye opener on how banks operate.
