One point of clarification....

The rent review took place in August as I said. The written notification was given with the 90 days notice as i said

The tenant verbally agreed to the increase but had not yet signed the new rent agreement as It was not due until Nov 1, obviously they hadn't paid the new rent either. And the rtb hadn't yet been informed of the rent increase because it hadn't yet happened.... Then rpz happened.....

Now the tenant is gone and rtb are categorically stating that I can only charge the old rent plus 4% for a new tenant....but had the tenant stayed I could charge the new rent !

The advice on here seems clear and makes sense, so why are the rtb so adamant?
 
Totally understood. I suppose I am just wondering if they could initiate prosecution if I do put up the rent or how does that work?

Even if I won the legal argument it would be months of stress / hassle / legal fees and basically would wipe out any benefit of rent increase...

That's my concern....
 
Well, your new tenants would have to initiate a complaint to the RTB that they are paying too much rent. The RTB adjudicates on complaints - it doesn't have a policing role as such.

To advance a successful complaint, your new tenants would have to know the rent your current tenants are paying. There is no publicly available register of this information.

I understand your concern but I think you are fretting needlessly.
