AIB How to respond to AIB's 2nd response to Appeals Panel

Just to clarify the context for this.
A) Anita made an appeal "The appeal"
B) AIB responded to this "AIB's first response"
C) Anita responded to this "The response to AIB's first response"
D) AIB responded to this "AIB's second response" That is what this thread is about.

Anybody get further correspondence from BDO?

I got a letter from BDO today attaching a 'Response to customer's additional submission' letter from AIB.

Cover letter from BDO gives me 5 working days to contact the Tracker Panel Independent Secretariat to seek permission from the Chairperson to submit a reply to AlB's response.

If I don't reply, they say they will assume I don't want to submit a reply and the Tracker Panel will proceed with the Appeal.

Hi all

I got a further response from AIB to my original response to their response. In the letter from BDO it says if I wanted to respond further I need to ring BDO within 5 days. I rang them today saying I wished to respond further and they said they would not forward appeal to tracker panel until they receive my further response. The girl I spoke to said there was no specific timeframe by which I had to have my further response done by. Once they receive it she said AIB would then have 20 days to respond further.

Update I attach the draft response that Brendan and I have compiled. Please tailor it to your specific circumstances if any.

It does not deal with every last point as we wanted to focus on the two key arguments.

Further update: Lainey has produced a variant of this response which you might prefer to submit. I have put it in a separate thread so that you can discuss that response separately.

Had a quick look at this during a study break this evening for an exam tomorrow!! So apologies if I picked something up incorrectly.
The tracker margin history they dispute was derived from AIB press releases. They're not accepting this as it doesn't suit their narrative of no prevailing rate.
Reintroduction of a prevailing rate?? You can't reintroduce a prevailing rate only set a new one which in turn becomes the prevailing rate and replaces the prevailing which was in place before it.
As per the banks explanation Then prevailing means the rate that exists or is available, as no rate was available the rate that existed for tracker customers in the same LTV bracket is the prevailing rate?

Ring BDO and tell them you wish to submit a further response. They will ensure your appeal does not go forward until you submit this response so it will buy you some time. I intend to draft a proposed response this weekend and am happy to share.

The entire response reads like an attempt to redefine the meaning of the contract to suit their position. A lot of words but very little substance to their argument. One thing that's interesting is their insistence that there is no contractual obligation to offer a tracker and that this is merely a service failure. They don't appear to accept that the terms and conditions that formed part of the contract are actually part of the contract! This seems mad to me, I cant get me head around it. There is lots of subtle wording to attribute meaning to certain things in this response and I intend to challenge it comprehensively.
 
Got this same letter yesterday, just called them now and getting 10 business days from when i receive next letter which will be next week sometime

Are we submitting a joint response on this like last time or is everyone going on their own ?

Hi folks, I also received the identical reply from AIB.
- Can I thank Brendan for drafting all the responses I have used so far. To be honest I didn't know where to start and would probably not have replied at all without this assistance.
- Hopefully we can put some sort of draft group response again. It seems to be if we keep the same angle we have strength in numbers.
- Although the AIB letters are full of content and rebuttals the point that seems to me to be crucial is where they claim "there was no breach of contract". instead we are told of a "service failure".

Thanks for the continued efforts all - FYI I got a good laugh at this from the response - "This reminds me of the Bellman in The Hunting of the Snark “I have said it thrice: What I tell you three times is true.''
