AIB Different argument but standard rejection letter from Appeals Panel

Brendan, Yes we got exactly the same response, despite not using your excellent template, as we had other specific circumstances I wanted to include, which they have made no reference to. I'm so annoyed at this lazy approach of the Independent Panel to their responsibility. We got ECB + 1.15% applied to 50% of our mortgage on 6 November 2008. 8 days later, we requested that the other 50% also be put on tracker. AIB now accept they should have offered us a tracker but argue about the prevailing rate. Surely the prevailing rate for our mortgage had been established 8 days previously as ECB + 1.15%. Their defence does not contend a specific alternative rate, just that it would be whatever rate would result in us not suffering financial detriment. How is this an acceptable defence? This would have to have been at least ECB + 4% in our case. How can the Panel agree that a rate increase from ECB +1.15% to ECB + 4% in just 8 days could have happened? And how can the Panel believe that this is interpreting the facts in the favour of the customer, given the lack of clarity in the contract? It's just unbelievable...

Trackaib, have the Appeals Panel already reviewed your case? Or have you just been given AIB's response to your appeal? Would you mind sharing the text of their judgement?

We got the same standard reply from the Panel, word for word, as set out in the first post of this thread. In it they repeatedly refer to us coming to the end of a fixed rate period despite this not being the situation in our case. They clearly had not even read our appeal.
 
That's appalling behavior looks like the FSO will be the first real review these get.
