KBC KBC basing cohorts on Application date rather than Draw-down dates

What you need to do is to a briefing note for him.

Set out the dates.
Set out the facts.
Include the documentation.

Ask him to ask them to clarify the criteria.

But KBC will be evasive. Anticipate the questions and the answers.

Brendan

I have contacted all three outlining my concerns, and got a response from two. Hopefully they will put it to KBC tomorrow

I don't know what the rest of the people on this forum think about meeting up in the coming weeks to but our heads together on this matter. We all believe we have been done wrong and if we all work together we might get a better outcome.

We all have similar timeframes and conditions in our loan offer letters. The most important question tomorrow,Is why people that have the same contract and timeframe as us have been deemed impacted and we haven't.

Absolutely no problem taking this further, fed up of their nonsense handling of this. Phoned this morning to find out why I was no longer considered part of the review, was told they didn’t know but would query and come back to me before the end of the day. By 4.30 I had not received a call so I rang again. Sorry no update for you, it will probably be 48hrs before we can respond, this is from the same person I spoke to this morning, why not just say that in the first place!

@Daisy duke Im surprised that you havent been given a reason. The agent explained definativley that I have been excluded because of the date of application

@DamC82 , I have no doubt that the date of application will be the reason they provide for exclusion, however they should also be able to provide clarity as to why I was ever considered in scope, if date of application was criteria for being included I should never have been part of the review?

The flyer clearly states that All IIB Homeland fixed rates will now roll onto tracker upon expiry and it is my belief that anyone that applied during this period or indeed drew down during this period should be impacted.

I believe you need to consult with Padraic Kissane since he is the one that produced the flyer in the first place and I remember very well that it was called a 'red herring' not too long ago!!

Some AIB accounts were deemed not impacted last year and are now deemed 'impacted' this year, so stay hopeful.

I suggest you get in touch with Padraic Kissane via his office.

I done so already lightening. All documents have gone to him last week

Being in scope or being considered impacted are two different things. There have been many people not considered impacted unfortunately despite being in the review.
If you push They will tell you that your account was reviewed because all accounts around that time were included.
Don't get me wrong I believe you should redressed, but I wouldn't waste time following that route.

There is a few of us on here that fits the criteria of the 650 private dwellings Nov06 -feb 08 that were deemed not impacted. Surely after listening to kbc tonight we were over looked.

Definitely Jazzer1 after the meeting I am a little more hopeful we were overlooked and like yourself should be included

I am less hopeful :(
Wim and Dara gave a very polished performance and the finance comittee for all their excellent work look like they are very weary and spun out..
kbc have played a blinder throughout all this and still seem to have gotten away handy enough ..
The attitude I sensed today was that kbc believe they are doing the 650 a favour by offering them a tracker and that they wouldn't have been forced to do so..anybody not 100% within the parameters they've set can whistle, tough luck..
No financial advisor or indeed anyone else will have success in these cases :(

Did she not say if you feel you have a case to contact her directly!.

I think that was addressed to the TDs. I would say that those of you who brought your cases to Pearse or Michael should ask them to send them to Dara directly.

Brendan

At least the hearing explained why it was just 650 in the cohort - seems about 6,000 had the "revert to tracker" written into their agreement and have not been affected.

There's definitely an arguable case for those who applied close to Nov 06 and drew down after Nov 06. - I'd be asking the solicitors who did the purchase for a look through your files to see timelines and if there's anything you have nissed that would back up your argument
