Stamp duty

Hi, Having bought a house off the plans in February 2006. The house will be finished in a months time . Since then i have moved to Kildare from Cork. Can i sell the house with out having to pay stamp duty? I will not be living in the house, so will i be forced to pay the 5% stamp duty as an invester.

I don't think so. You are effectively buying as an investor as far as I can see so you may be liable for investor SD and CGT on any gain arising from the sale onwards. Might be worth checking with your solicitor or a tax advisor.
 
Thanks for the reply..i paid 299k for the house and is now worth only 305k would that mean i only pay SD & CGT on the difference or the complete price?
 
You would pay SD on the purchase price. CGT is paid on the difference between selling price and purchase price, less allowable costs.
 
And don't forget that the SD is payable on the purchase price before VAT.
