Hi I wonder if anyone can help out I've been in negotiations with the bank now for well over a year. I've two investment properties in negative equity. My own home is with the Same bank and not in negative equity. They have refused our offer of repayment on residual debt after agreed sale of buy to let properties. The offer was based on the sfs we supplied to them. The buy to let's are not secured against our house. There is €100000 outstanding on our home loan. They are now talking about taking legal and the prospect of a judgement mortgage on our home. The loans are in both mine and my wife's names. Can they make us sell our family home with the judgement put onto it.

It would be very unlikely that they would be able to force a sale of your home. To do so, they would need to do the following

1) Get a judgement for the shortfall
2) Register it against your home
3) Get an order for possession

1) and 2) would be easy enough, but 3) would take a long time.

It's possible, but it's very unlikely that a judge would grant such an order. Why don't you post the full details in this format?
