Buying a site planning/legal questions..

Hi,
I have a couple of queries that i hope you can help me with.

I am planning on buying a site from a farmer locally subject to planning permission but have a few questions.
1. I built a house 5 years ago so will this affect my chances of getting planning permission again in the same area with the council.
2. If the above is true my brother has kindly agreed to let me use his name on the planning permission application (lives in England). Are there legal complications of having one name on the planning permission and another name of the purchase of the site. And if so could it affect the selling on of the house in say 5-10 years time.

Any advice would be great.. Thanks..
 
Does your local authority have a 'locals only' policy?

If you've lived in the area for the past 5 years, that will show your commitment to the area - so should help.

If you use your brother's name, people will look at the site notice and ask, 'who he'? - which might be bad. Might also be illegal (which AAM doesn't condone)?
