Redundancy Notice

Hi there
I am with my employer almost 5 year therefore my stat redundancy notice should be 2 weeks. The are only giving me one week.

However my contract of employment states the following:
“This Employment Contract may be terminated by either party upon one month’s written notice, effective as of the end on the calendar month”. Therefore this notice period overrides the statutory requirement.

If I receive notice on Friday Mar 7th does the above statement mean it is effect as of the end of the calendar month - therefore March 31st and the termination date would then be April 30th.

Any opinions on this one.
Thanks

Contractural notice cannot be less that statutory notice. In your example your notice would expire on the 31st march which would be the termination date

So based on your response I will only get 3 weeks and one days notice not 30 days.
