Hi, current predicament is that it appears poor design and workmanship have caused a retaining wall to rear of my house to lean forward.

I've attempted to claim via my own insurer but it's been denied on above grounds and on a clause that says there is no cover unless the house is damaged by the wall, which it's not as it's not fallen over yet.

The builder has admitted fault, I still tried my own insurance as he reckons his wouldn't pay out. The work needs to be done now and I can push him to stump up and he will but from the limited info I can post here is there any way he could claim successfully?

There was no contract or plans, he just built what we spoke about.

He may not have any cover, in any case even if he did he would prefer your insurance to be used as its your premium that will rocket.
Time to put the boot in:)

Nope. His policy wont cover the rectification of bad workmanship. Why cant he just fix it?
