Hello

I just received a letter saying a judgement mortgage has been registered against our jointly owned house for debts run up by my
ex partner.

Can anyone tell me please what this means?
 
If you sell the house, you must first discharge the ordinary mortgage on the house.

If there is anything left over, her share of it must be used to pay off the judgement mortgage.


In theory, they could seek to force the sale of the house to get the judgment mortgage paid. In practice, they are unlikely to do so.
 
Basically means the lenders have had a hold on your house, depending on how much money is owed. The lenders could A - do nothing more now but if you sell the house then the debt would need to be cleared. B. If it is a very large amount of money the could try force the sale of your house.

If you have a current mortgage this will be cleared 1st so the lender would be less lightly to force a sale unless the current mortgage is very low. Otherwise they would not get their money back.
