Reimburse Company Top up to Maternity Pay

My company has topped up my Maternity Benefit to provide my normal salary. The stipulation attached was that if I left the company within a year of returning to work I would have to repay a certain % of this company top up depending on how long I returned to work for, 6 months, 9 months a year etc.

My question is, I took an extra 16 weeks unpaid maternity, does my 'return to work' commence at the end of my paid maternity or does it commence once I've the unpaid leave taken also?

You'll have to clarify with your employer, but if you are off on unpaid leave, it's reasonable to assume your return to work is triggered when you actually return.
