Rent increase - right to refuse for duration of leaving notice?

Hi,

If my landlord were to raise the rent, when does that increase rent start from? Do I have the option to decline and move out and keep the old rent amount for the notice period of the Part IV tenancy?
 
The landlord is required to give you notice in writing of any rent increase at least 28 days before that increase. The notice must contain the new rent amount and the date from which that new rent is payable.

If you would like to stay and avoid the hassle of moving you could:

1. You can try to negotiate the new rent with the landlord, especially if you have been a tenant who has always been on time with the rent, and has not been involved in any anti-social behaviour.

2. You could lodge a claim with the PRTB that the new rent is above the "market rate". You would have to have evidence that the rent is more than other dwellings in the are, of similar size, number of rooms etc. and that the new rent is more than other landlords are asking for a vacant property and a tenant is willing to pay.

The last option is that as soon as you receive the official notice of the increase, serve the landlord with your Notice of Termination giving him the required notice period and leave the property. Unfortunately, you have not stated how long you have been living in the property as this will affect your notice period. If you have been there for more than 6 months but less than 1 year then you must give 35 days notice, but the landlord may agree to less especially if you fined somewhere else during before the notice period expires.
