There is a condition on the planning permission for our house that we cannot sell it within 10 years. If we wanted to sell our property now (3 years later), could we do so without consulting the county council or is there a point in the process where that condition would rear its ugly head and we would have to get clearance from the council? Has anybody else had this situation and overcome it?

It will become very clear, very quickly to any prospective purchaser and the EA should be told very early in the process.

In certain circumstances, the County Council may be able to waive the condition. It depends on the circumstances.

Thanks, mf1, I figured as much. I think an exemption can be obtained but you have to sell the house to somebody else that qualifies as being "local" enough for the county council, which obviously makes it a much smaller buyers pool.
