Hi,

I hope this is the right location. My friend has split up with his girlfriend there house is in negative equity by 100k she has moved out and is not paying anything towards to mortgage and she just wants him to take over the full cost of the mortgage. I know if this was in equity she would be looking for her share of the equity in the property.

Does anyone know of a good solicitor in Dublin who would be able to advise him on what course of action that could be taken as he can not afford the repayments on his own.

They both signed the mortgage agreement so I presume legally she should be paying half of the mortgage.

All advice appreciated.

They are both jointly and severly liable for the mortgage. Does she understand that? If he cannot afford it then he should try and come to an amicable arrangement with her helping to repay the mortgage. The bank will eventually come after whoever has the most money/assets/good job. So it if better to talk to a solicitor and also engage with the bank.
