    Servicing Electric Storage Heaters

My experience is that people do not get them serviced but wait until something goes wrong until they get an electrician in. Yes an electrician is the person to contact. They are fairly reliable and the vast majority of problems (in my experience) are caused by people putting clothes on them to...

    Over charged on my Mortgage

Really good advice - get them to outline in detail how they calculated the refund due. You are due interest on the overpmts as from the date they were paid etc....

Tenant has sent solicitors letter demanding deposit back.

Was it a fixed term tenancy or a periodic (mth to mth) tenancy that was signed? A written notice of termination must be served by tenant giving 42 days notice as they were in occupancy for between 1 to 2 years (if it was periodic). If it was a fixed term tenancy the tenancy should last for the...

First time landlord: interest allowable as an offset to rental income is 75%?

Correct - that is my understanding. 75% from 01/01/11 to 31/12/11 unless this changes in the upcoming budget!!! Unbelievable, they take your stamp duty and then undermine you!

    Window smashed, who should pay?

The person who damaged the window should pay for the damage. Make a statement to the Gardai and insist they follow it up. If there is a recurrence then you have a decision to make as regards the tenant - I appreciate she is a good tenant but at some stage you will have to ask yourself if this is...

Wits end Mgt Co -€1.5k pa but no cleaning, no bins being collected, no grass cutting!

Little Miss - feel so sorry for you in this situation as you are paying your service charges and subsidising other owners who have not bothered to pay their charges. The Directors of the Management Company are ultimately responsible for putting things right as they are supposed to be running...

Mgmt fees -paid in advance or arrears?

Should be paid in advance or at the very least on a monthly basis as costs are incurred. Otherwise, managing agents may not be able to meet current expenses especially if some members are in serious arrears. If this happens everyone suffers including those who are fully paid up to date.

Legislation that developer must contribute towards maintenance fees for unsold units?

Hi Dubshelley, bit late on this but anyways. My understanding is that service charges are only payable by the members of the Management Company. You only become a member when you purchase your unit. The developer is personally responsible for meeting all costs in relation to his unsold units...

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Hi Marietta, no cameras unfortunately. I rang the guards - they asked me "Was there any point in calling as the culprits did not gain entry?" I spoke with all the neighbours but no-one witnessed anything suspicious or heard anything. Most of the damage was caused by a crowbar being wedged...

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Mercman - just reread your note. Actually there is only one door as it is an own door apartment with no common lobby. Similar situation to any three bed semi-d. I am going to sort it out myself rather than going through the Managing Agent / Management Company. Thanks again.

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

I had thought about this ... whoever does the work will have to purchase a new door from the original supplier as it is an external door and will have to be in keeping with the other doors in the development. I went direct to the original manufacturer and have ordered up a new one.

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Thanks Sam for the advice - will do as advice based on the facts presented is welcomed but advice based on clouded thinking is best ignored.

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Re: Insurance. The management agent organises a block policy on behalf of the management company. I in turn pay a service charge to cover the cost of same. As I understand it an excess of €1000 plus is fairly standard for block policies so I think it is unfair to suggest it is a cheap insurance...

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Thanks Berni for the comment - I see that a door would be considered part of the structure. I will cover the cost myself and take it on the chin.

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

" If tiles fell off the roof would you ask the tenants to pay for it?" Fair point - I think the cost involved has clouded my judgement. I obviously had not planned on a bill of this size.

Attempted break in Damage to Door - Who is responsible LLord or Tenant?

Hi All, I let a property to excellent tenants and I consider myself to be a fair and reasonable landlord. There was an attempted break in at the weekend and quite a lot of damage was done to the front entrance door. Thankfully the perpetrators were unable to gain access. The door will have to...
