Entitlement to proceeds of life assurance policy

Thanks for the reply. I found this quote on the Revenue website under 'Executors' "Examples of assets which pass outside the will or intestacy Death benefits passing under a life insurance policy...where the beneficiaries are particular family members named in the policy or scheme." This would...

Entitlement to proceeds of life assurance policy

Thank you. The policy was taken out in the name of the two children only, not the husband. The insurance company has issued a cheque payable to both children. Is the remaining spouse automatically entitled to one third?

Entitlement to proceeds of life assurance policy

To the best of my knowledge, the deceased took out the policy and paid the premiums. Would it have made a difference if the spouse had done so?

Entitlement to proceeds of life assurance policy

An in-law died recently and there was a life policy payable to her two children. They were the only beneficiaries; the remaining spouse was not included. He is now demanding one third of the proceeds and claims to have received legal advice saying he is entitled to this. Is this correct? I...

    Waterford Crystal Pensions

Great news for the WG workers. Fair play to them for persevering with the case. In a way, pensioners in insolvent companies may now be better off than those in underfunded schemes which are closed. They have no legal protection whatever. In the De Beers/Element Six case, losses were up to 60%

No TV so No Licence but still getting final demand notices

I was threatened with legal action a few years ago for having an aerial on the roof (there was no TV) and I was forced, through gritted teeth, to buy a license for the aerial after a long conversation with a very stroppy employee in An Post. I got absolutely nowhere with him, even after inviting...

    japanese horse tail in garden

I assume you're referring to Japanese knotweed. I got rid of it (a small area) by digging up as much as I could and covering the ground with plastic weed suppressor which stops the light getting through. Any bits that showed up later (or the following year) I treated with systemic weedkiller...

    ARF lump sum query

Liam, thanks for the helpful comment. At redundancy, I made a specific provision for 1.5 times salary as a TFLS at retirement. If I now take option 2 (25% of fund + AMRF + ARF), I will get a tax-free sum considerably greater than the original provision which I made. Does that make sense - NOT...

    ARF lump sum query

I don't fully understand the mechanics of the operation but I think that the DB fund proceeds are being chanelled, via the company's DC scheme, into a bond and then to an ARF on retirement. That's what we have been told by the trustees.

    ARF lump sum query

When I left my former employer in 2008, I paid more tax than was strictly necessary on the redundancy lump sum in order to be able to claim a tax-free lump sum on retirement of 1.5 times salary. This was done under the Defined Benefit plan and Revenue rules at the time. We are now in a situation...
