Covenant Permanently incapacitated minor

My daughter is 14 and has a severe intellectual and physical disability. My sister set up a covenant for her in December 2012 for 5k and my brother set up a covenant in Dec 2013 for 6k.

This money is used to hire carers to assist with her complex medical and day to day needs. She need 24 hour care.

When the covenants were set up the revenue says that they must be capable of lasting for more than six years so the 'deed of covenant' form give my revenue is for a period of 7 years.

Therefore these covenants need to continue until Dec 2020.

My daughter will become entitled to disability allowance in 2018 so will not need covenants to pay for her needs. In addition both my brother and sister's personal situation has changed as they now have children of their own so cannot afford to maintain payments.

If my siblings terminated covenants a year or two early, does anyone know the implications

Thank you

Was in the same situation a number of years ago. I think my sons finished up after year four. There was no problem just ceasing the payment,

The deed only has to have the potential to last in excess of 6 years.

The relief given for the years for which the payments were made will not be clawed back.
