Emobile - allowing break in contract - is there a penalty?

Emobile have almost 100% confirmed that they will allow me to break my contract - So many blackspots in my coverage! its been a long long summer!!!!!!

Can anyone tell me
- will i be charged a penalty (12 months left in 24 month contract)
- will i have to return handset - i paid 200.00 for phone or do I keep the phone
- will i have to give 30 days notice of cancelling or as they have acknowledged the problem is theirs can i get out of it straight away?

Any assistance would be appreciated!!
 
Girl in customer service said that it would be up to the manager whether i would be allowed out of contract or not.
I didnt mention about penalty - if problem is on their side why should I be penalised?

concerned about losing my money for the phone also!
 
Sounds like only the manager will be able to answer your questions. Poor coverage in key areas is often a good enough reason to get released from such contracts, but this needs to be highlighted early in the term. You mention it's been a long summer, so perhaps you did raise this early enough.

The phone is likely heavily subsidised (depending on the phone/ plan), so they will be entitled to reclaim it or charge you should you wish to keep it. The T&Cs of the offer you signed will likey state this.
