My ex's PIP says he can get my name off the joint mortgage?

H laurette(my sisters name but spelt differently).firstly i dont know the figures regarding the property.but if you can get 8 grand from it hun(doubtfull)you go girl.But in my circumstances i wasnt going to even contiplate it.i signed and ran and never looked bk.but if your struggling with maintenance etc,try come to an agreement with the father of the kids,(if he is the co borrower).use that tool...12 of october just around the corner,so you need to act fast.who is your x partners pip?
 
Separation/Divorce cases are the most difficult to advise on due to their complexity. I set out below some comments that you might find helpful:

  • Are you currently owed any money for maintenance? If your partner owes you money for maintenance, you should be listed as a creditor on his Prescribed Financial Statement. Monies owed on maintenance are a special category of creditor called "Excludable creditors", meaning that you are not bound by the PIA unless you consent to being listed as a creditor.
  • Restoring your partner to solvency should make it easier for him to make future maintenance payments. Accordingly, it might actually be in your interest to support the PIA.
  • Creditors generally accept that maintenance payments have to take priority. This may be the time to negotiate larger maintenance payments as a quid pro quo for you giving up your interest in the house, which would form part of his PIA going forward.
  • if you owe monies to other creditors, you should consider doing a PIA yourself.

Also laurette,i got my x partner too put the 3 kids on his will,reg the property through the family courts,so at least there future covered..☺

I know this guy.who was in similar situation.He was in the navy.partners mother robbed money outta there account,when he went to do something about it.the kids mother turned into a local tramp and denied him his children.He fought through the courts for access etc,and also got the house in the end.keep fighting was his motto.
