Looking for advice. My father in receipt of farm assist. Due to family law case he has to raise 100k. He's looking at selling 39 acres to son. Gifting him 13 acres to use as security for the bank.

As he will own no land he will have no eligibility for farm assist.

If he applies for jobseekers could social welfare say he deprived himself of an income by gifting 13 acres...

Considering its a family law case with time limits on it by the courts.

Is there special circumstances / legislation to deal with these scenario's?

Any advice appreciated?
Thanks

Ford5610,

Surely his biggest issue is getting any lender to give him K100? unless son has the k100?
Should he get the k100 in his account that will trigger a review of his farm assist or indeed any social welfare payment.
I just can,t see Farm Assist changing rules in that scenario.

From experience Social welfare people are helpful , so go ask them , before he (might) puts his foot in it.

Are there 39 acres or 39 + 13 acres= 62 acres? What is the actual value of the land? Because if he is selling either 39 or 26 acres for 100k, either the land is very poor, bordering on bog/forestry only or he is under valuing? What kind of farming is he doing?
