A bank account "disputed account"
The issue may go to ombudsman.
Can the ombudsman apportion blame with who he finds to have acted wrongly?
Can the ombudsman award damages against them if they are found to have acted wrongly?
If yes, has the particular amount to be claimed in advance or on investigation can the ombudsman decide the amount if any, on damages done?
 
This is a little vague, but I might offer an opinion on experience I have had with the Ombudsman. The FSOB is supposed to be an independent statutory body but is paid by the Financial Institutions in the state. I, in hell fail to understand how a fair determination can be made against the firms that are keeping his office open. I have found that all the complainant's papers has to be in order. Yes, he does find against those that do wrong but if one is seeking massive damages you ain't going to get it. And if you don't like the determination a High Court case must be taken quite quickly. And if there are serious issues, the Ombudsman is duty bound to report to the Central Bank.

The bank failed/refused to process documentation following a particular event.
Professional persons made in my opinion unwise reports to the bank.
What do you mean by "all the complainant's papers has to be in order". What exactly do you mean by that?
Copies of all docs are available in the bank and in the offices of professional persons and are available to be sent to the ombudsman's office if they require them.
Also the complaint form is clear and precise in my opinion.
Massive damages is not what this is about but damages to remedy in line with similar cases is fine.
If damages are appropriate has the quantum to be requested in advance of the enquiry or is that quantum decided by the Ombudsman following his examination of the complaint.
As a novice in this area views are welcome.
 
In the first instance you must receive correspondence from the Bank in response of your query. Every shred of paper concerning your complaint must be forwarded to the Ombudsman. Each case is different but you are allowed state your preference. Regardless the Ombudsman makes the final decision. If you're not happy with his direction you have the choice to appeal through the Courts.

This is like saying that we can't trust the Gardai to prosecute criminals because they sometimes pay tax which funds the Gardai.

The Minister for Finance appoints the Ombudsmans Council, not the banks.

You won't agree with every decision he makes, but he is independent.

That issue is not being disputed. But who or which parties pay millions annually to keep the FSOB open ? Matter of fact it's the Financial Institutions.

Furthermore, there have been quite a few decisions made by the FSOB which have been overruled. And Senior Judiciary have been critical of the FSOB and Institutions as to the manner these parties have acted.
