1. Just wondering if there were any guidelines on the percentage of rental income a bank classed as income when assessing someone for a mortgage. 2. Also should a bank still have all the paperwork used to assess your suitability to get a mortgage on file? ( going back to 2005). 3. Was paying towards a customers legal fees allowable in terms of rules of conduct ?
 
Bank's will have all documentation pertaining to your mortgage as required by SI 853/2004. Look for the valuation report, section 123 CCA 1995 refers, banks regularly breached their own criteria for giving out mortgage loans. If the property was a buy to let, then there was usually a rental income criteria in the banks internal documentation regarding the application, ask specifically for the loan officers aide memoirs etc with respect to your application ( as these documents refer to your loan, it's is encompassed by the Data Protection Act, bank's don't like giving out these documents, but you are entitled to same. ) This criterion was regularly breached by banks during the boom and such a breach is a breach of section 16 of the EC ( licensing and supervision of credit institutions ) regulations 1992. Indeed in some instances it can be classed as mortgage fraud on behalf of the bank (body corporate rule), especially if the loan officer dealing with the application signed a declaration or confirmation that they have abided by the banks lending practices with regard to the mortgage application, when in fact, they have not.

With regard your original 1st question, you should ask the bank the question directly, different banks use different % for this calculation. Question 3 - answer yes.
 
Many Thanks Rebuttal for the info and detail. I have a request in seeking Aide Memoire. To date they've given me a certain level of the paperwork...but not All of it! I wonder has anyone else an aide memoire to see what level of detail the bank officer made/noted. My mortgage chap at time was a 22 year old...who even had the 'wisdom' at the time to remark that 'interest rates won't go up'. (Hearsay though) thanks Rebuttal!
