Is it a criminal offence for a local authority tenant to make false allegation to the local authority about another tenant.?
 
No. Defamation is a civil offence and not a criminal offence. A criminal offence can result in a jail sentence.

Defamation does not have to be published.
If published and you can prove defamation you can sue for damages. (not to be recommended)

If verbal you will have to rely on your word v theirs , ie get nowhere.
Or have a 3rd party who is prepared to go to Court as an independent witness and confirm defamation to the courts satisfaction.(unlikely anyone will wish to get caught up).

In any event unless the alleged defamer has (funds) you will get nought.

You are obviously irate over this , but maybe least done is your best action? and hope things blow over.
Be very very careful not to say anything extra, in other words {shut up} because things have an unerring habit of escalating!

If things re-arise and don,t blow over , a well worded note from a solicitor might help ,( by well worded , I suggest explain you are hurt by alleged comments and would wish them to halt), but ONLY do that if things don,t cool.,
 
It is not just irate. i do not want falsse allegations on file about me. No fear i will say anything. If the person has no funds what action can be taken to stop them doing it. If a solicitor writes and tells them stop and they continue what then? i do not want money i want to have my name cleared. thanks
 
You should simply write to the Local Authority and set the record straight.

No need to be paying solicitors to write letters which will make matters worse.

they will not change it. in fact it will be going to data protection too.But I am not sure if they will be made delete it as they say they record everything. this is persistent alleging something that did not happen i do not want it on my file
 
Can you make an application to the local authority for disclosure of the information held on record under the Freedom of Information Acts ? I suggest this first to see what the actual evidence is before deciding the next step...
