I sold my car last month but the new car I was buying wasnt going to be ready for a few days, a friend of my husbands gave us the lend of a car he had just got for a few days, I went online and added it to my insurance, paid €20 and thought nothing more of it.. got stopped by an unmarked checkpoint on way to get new car asked to produce insurance within 10 days, get onto insurance company to find out that it had somehow not gone through the system, checked my bank acc and money had not been taken.. what do I do??
Ive been driving 15 years and have always had insurance..
Myself and my husband were going through a very rough patch at that time my head was all over the place..

Surely the friend should have added you to his insurance (as a temporary driver) rather than you adding his car to your policy? Is there any chance he may have done that?

No, he got the car as a trade in... I had my insurance paid in full on my other car and it says I am covered to drive other cars but I dont think that will help me :-(

yes it will. The "driving of other cars" on your policy usually specifies that the "other car" must not belong to you. It doesn't so if your policy is a like mine and most others I've seen you're covered 3rd party, in other words you were driving legally at the time you were stopped.

Get thee hence to Garda station ASAP with insurance policy and certificate and proof of ownership of the other vehicle (Garda should have access to this though), so have reg. no. At least.

+1 to the above.(Mathepac)

If what you have said here is accurate then you were insured.
The only "fly in the ointment" is that it was your original policy on the car that you sold last month and therefore you no longer have an "insurable interest" in that car so your policy MAY no longer be valid.
But if I were you I would not volunteer that information to the Gardai.

Ask for the insurer for the recording of your call. You didn't cancel your policy, you attempted to transfer it. They failed to transfer it so the original policy stood details stood.

If they can produce the recording, you are covered. If they cannot produce the recording you are covered. +1 to saying nothing to the Guards and say plenty of it. You tried to do the right thing and your insurers let you down (123.ie by any chance?) You should not have to suffer the consequences of their incompetence.

I did (thought) it online.. I'm shitting bricks here... I dropped my old.ins cert to the station before I realised I wasn't actually insured on the borrowed car.. Id say I'll be getting a summons...

Surely you just had to produce the cert for their perusal and did not have to leave it with them??

I assume they then saw the clause stating that you were insured to drive other cars?

If they still have it drop down ASAP, point out that clause and redeem your cert.

You can stay off the toilet, but you must show them the cert AND the booklet / schedule together as the cert refers to clauses in the booklet. Either document on its own is pretty meaningless. Get your cert back ASAP. You were insured on the night you were stopped but you must be able to prove it with YOUR documents.

In whose name was the Policy? If in YOUR name and you have DRIVING of OTHER CARS (DOC)extension, normally given to those aged over 25 with a full licence, then you should be covered. If the policy is NOT in your name, then you do not have Driving other cars extension and you are not covered. Read the certificate if it is in your name as not all insurers give DOC. Some of the cheaper online providers might not provide it free of charge.

Have been summoned to court next month, I have all my documentation but I have been unable to get in contact with the guard.

it boils down to whether you were insure or not. It is quite clear. What does your Policy say and have you been in touch with your insurers? As I said in my previous post, if YOU are Policyholder and your Policy covers driving other cars, then there is no problem. If you do NOT have driving other cars, then you are uninsured and need to consult a solicitor. You WILL get a fine; if it's your first offence for no insurance you probably will not get jail; you may get a disqualification and your premium will probably go up next year.

I was insured to drive other cars .
I am the policy owner.
Fully comp.
Full licence.

Then you are covered.

Apologise to the judge for wasting court time, but point out that you made every effort to contact the Gardai but were unable to do so before the court date. Keep a record of dates and times you called to the station.

Best of luck.

Oh I hope so, I'm debating hiring a solicitor, but I don't know if there is any rwal need.

if all is in order, talk to the Garda on the morning. He'll have to be there, or if not, there will be some garda prosecuting you. Show him the documents and the case should be struck out. Good luck
