BOI Personal Debt 16K Summons

Hi All,

I have received a summons for a 16K loan which i have failed to pay back to BOI

I have not made a payment in 4 years

Truthfully i fell on hard times and i could not pay it.

I also fell into 30K arrears on my mortgage which has now been dealt with thank god

However the debt is mine and i am responsible

I am back working and things are looking reasonably good

I have to complete a statement of income and outgoings for the bank

The court date is for a local court

This is my first time in court

What can i expect .. ? what can i do?

What realisitically will happen to me with regards the debt.

any thoughts or comments really appreciated

Do i contact a solicitor?

BOI will get a judgement against you and then seek to enforce the judgement probably through an installment order. You owe the money so there is little point in offering a defence at the judgement hearing - the bank has to get the judgement before they can try and "force" you to pay up !. Getting an installment order involves the bank going to the district court to get a judge to decide how much you can afford to pay - you will not be made pay what you can't afford. You need to attend this hearing to show your means or get someone to attend on your behalf ! If the court date is some time away I would talk to MABS and see if you can come to an arrangement with BOI. MABS will also be able to advise you if you qualify for a DRN.

It is very good you prioritized your mortgage debt and that that very big issue is resolved.

Even at this stage it might be no harm for you to write to Banks solicitors and explain that you had to cover mortgage first but can now start to work on the k16 and that at all times you wished to cover any due debt.
It is not really in anyones interest to go to court.
. Request that case be put back for now ,for the reason your finances are now in a better way to enable you to come to an acceptable arrangement that you can afford.
If Bank still proceed for a judgment ,so be it , that is not in your control.
But you can show to the Court , that you want to sort this.

Make sure you keep copy of any correspondence.
