joint mortgage for 5 years (no married). Inheritance and lump sum questions...

Hi all,

I have had a joint mortgage with my girlfriend for 5 years. We are not married, have no will and no kids.

I have a couple of questions
1- Without a will, if I was dying tomorrow, who would own the equity of the house I have already paid? Will it be inherited by her?

2- I have received some inheritance money which will allow us paying the mortgage in a lump sum of 200K. If I pay the mortgage and we break up in the future, I would of course want that fact to be taken into account when reviewing the ownership of the house.
I guess that draft agreements can be done at any time? Not just before buying the house?
Also, would the draft agreement be valid in case of marriage?

I'm going to suggest that you make an appointment with a solicitor to make a will and discuss these issues. There is far too much money involved to be trying to rely on strangers advice on an anonymous board.

When you bought the property together, you will have chosen how the ownership of the property was to be held - you need to review it and check if it meets your needs.

It would be useful if you went to a solicitor who has knowledge also of Spanish law and tax.
