My new card and pin intercepted

I ordered a new card and pin and it was sent to my apartment. I noticed that a few fraudulent transactions had occurred on my account. The card is now cancelled. The new card and pin was intercepted in the post. My question is willi get this money back? The thing is, I have my apartment rented out. Will I be deemed negligent to have had the card and pin sent there? I collect the post regularly. Thanks
 
I think that you'll struggle to get the money back.

Have you reported the matter to the Gardai?
 
How are you sure your card and PIN were intercepted? Did you get the card and PIN or did they apparently never turn up? If so, did it look like the envelopes had been opened or tampered with? If not why aren't you having strong words with your tenants (though admittedly there's no proof they did it)?
 
Yes they are sent separately, generally with a couple of days between them. So it would seem that someone in the apartment must have copped what they were and used them....

Might be cheaper not to get your money back, how much are we talking about ?

The cards are now cancelled, no more harm can be done in that regard, and so you know exactly how much you have lost.

To pursue this issue might lead to a higher interest rate on your mortgage as presumably the reason you had your card and pin sent to the apartment is you want the bank to believe it is still your PPR, and as such you are paying a PPR rate rather than the higher investment rate.

If this is the case, it might be better to take the hit, move on, and look at ways of getting new tenants.
 
If this was a credit card you may have an entitlement to a chargeback on grounds of a fraudulent transaction and that you never received the goods. You've no way of knowing where the cards and PIN were intercepted which means you don't know if it was at the bank itself, An Post, your tenants or tenants elsewhere in the block. Apartment mail boxes are notorious for being broken into

Might be worth changing the lock on the mailbox in case it was not your current tenants.
 
My replacement card was intercepted in the post before and used fraudulently (i didn't even know it had been taken. The bank informed me). However it was before Chip and Pin - so the culprit signed the blank card and used it locally. The bank cancelled the card and i wasn't hit with any costs.
