Liability for new Spouse

My sister is soon to marry someone who has a property in serious negative equity .

My sister has substantial savings.

Could her future husband's bank have any claim over her savings after they marry? and how
could she protect herself from same?

Could a pre-nup help?
 
The bank has no claim on here money after they marry. But if he is trying to come to an arrangment with his bank they may want to know here earnings and assets. She can of course refuse. But it might make it harder for him to get a deal. Naturally enough she doesn't have to disclose it.

They would be probably smart to have her money in a different bank to his. And be aware that banks exchange information - I had a case more than twenty years ago now between the two pillar banks.

The NE of course is not an issue if he has no problem paying back his loan.
 
Thanks for that Bronte , unfortunately my sister is helping to pay the mortgage as he cannot afford
the repayments himself.

Just as you implied - I think the bank will start to look at her savings if this couple want to remain in
his house !!!
