Is charging rent part of my duties as an Executor?

Hi,

Would like to know if anyone has any helpful information about this process before I visit a solicitor.

Basically, I am executor of a will for a family friend, which leaves a share in a property to one beneficiary. She wanted to sell the property but the owner of the other share is unwilling to do this as they reside there. She now wants me to charge that person rent as they are using her share of the property.

Is it part of my duty to do this?

And if so what is the process?

It's not your problem.

Vest the property in their names and let her try and charge rent to her co-owner herself.

Basically if she wanted to sell the property and the other share owner wanted to keep the property then the other share owner should have given her half the value of the property once they got reasonable valuations and agreed what half was worth.

If they couldn't afford to pay for half of the property then this should be sold and the money divided between them. I cant see how this person should get the full benefit of the house without paying the other person there entitlement.

You should probably seek the advice of a solicitor.

I intend to get to a solicitor in the next few days.

I was hoping that it was something I wouldn't be required to do as I don't want to involve myself in their dispute any further than required by my duties, and I personally don't think any attempt by me to request rent will be successful anyway. But on the other hand I can see her point as the probate process has just begun, and it will be about 6 months before she can take any further steps to try and get the house sold.
