Hi All,

Just wondering can anyone advise where I can get info on regulation of shrub/hedge heights( private dwellings) separating bounderies of land.

Me neither. If there are then they must be widely ignored and not enforced!

Neither did I until the next door neighbour starting cutting down our hedge(without telling us) demanding that it cant be above 6ft.

Have you asked your neighbour for details of the relevant legislation?

Wow id be really annoyed if a neighbor did this to my property . Its a classic case of people jumping the gun and demanding rights they don't have ! If they dropped into you and asked "would you mind if i trim your hedge as its darkening our garden " I'm sure you would not have minded ? but this behavior is unbelievable ! its your call now as how to approach this .My advice would be to drop in for a chat and tell them that if the height of the hedge is an issue you are happy to come to some agreement of height ,but you are entitled to grow anything on you own property to any height ,and their belief that they have a right to trim your hedge on your property is unfounded. keeping good neighbors is always the prise to aim for IMO.

Not sure if you are in an estate or in the country but part of planning is that you are supposed to submit a landscape drawing with what trees will be planted as certain species are not allowed to be planted..so maybe it depends on what you planted but i think that cutting down of your hedge especially if its on your side of the boundary is illegal...it would be considered malicious damage which he could be liable, the council should tell you this, try the planning section or contact the gardai and make a formal complaint against him...

Hi Johnnyg,

We are in the country. Not sure if there was a landscape drawing. The house was built around 30-35 years ago and the hedging was set back then too. So I'm still wondering is there such a law that hedging cannot be higher than 6 feet?

I would call the guards and report this malicious/criminal damage. Tell your neighbours that you are very disappointed with them( best in writing) and will be seeking advice on the matter. how would they feel if you went in and started messing with their garden/property?

back that long i doubt it and i seriously doubt if there is a height restriction, the only restriction we have in the country is that you must maintain your hedgegrow so that it's not impeding on the road and thats enforced by the county council, so check with them.
Has he completely cut your hedge or did he stop when asked? I would report it to the gardai asap and let them deal with cautioning him or charging him with malicious damage especially when he showed no disregard to your property or to you

I always understood that the neighbour could only cut any branches, shrubbery that crossed into their property, they cannot touch anything inside your boundry.

I am afraid your neighbour has comitted an act of criminal damage against you, obviously not very nice people.

He is claiming that he is well within his right to cut and that there are laws about this.Which I cannot seem to find info on these anywhere! So am I right in saying that there is no such law as this?

If you dont have to much bad blood between you I would think you are better off trying to reason with him ,the hedge will grow again not to sure about the relationship especially if you resort to law
were you blocking out his light or what ..anyway regardless he cannot cut down anything once it is within your property if it hangs over his side he can chop away but only on his side.

can we take it that he cut the hedge back to six feet which means that you still have your privacy or did he chop the whole thing away

No such law Dublin anyway. My parents have just installed 12ft high trees at the back of the house - landscaper says they are perfectly within their rights. This however does not apply to fences/walls etc, they have to be within a certain height - trees any height. Neighbour has right to cut off branches that overhang his property but not cut the top of the trees.

I am not a solicitor, however I do know that no one can enter your property uninvited and damage your property, whats next on this guys agenda, the position or colour of your satellite dish ! its called criminal damage

I believe the guy is bluffing and had absolutely no right to cut your hedge

I thought that alright. I will have to try sort first he was complaning about the dog, so we had to get rid of the dog, now the hedge god only knows what will be on his agenda next..........

Take pictures, call the gards just to make sure this is registered with them. Might come in handy down the line.
